 Rick Tubb focuses his practice primarily in the areas of probate and trust litigation, probate procedures, estate planning, and commercial litigation. He also has extensive experience in real estate litigation of all types and has handled many real estate sales and lease matters during his career. Rick has been rated AV Preeminent® by the peer-reviewed Martindale-Hubbell® service for 25 years.

 

Rick began his career with the firm now known as Godwin-Bowman and practiced for several years with Bracewell & Patterson, now known simply as Bracewell, LLP. He served as a trial attorney for the Federal Deposit Insurance Corporation for several years before opening a solo practice for twenty-five years prior to joining Farrow-Gillespie Heath Wilmoth LLP.

Probate, Wills and Trusts

• Represented heirs of deceased business owner in protracted litigation against fifth wife who claimed disproportionate interest in estate and obtained a favorable settlement

• Represented large Dallas church in trust litigation against claims of children of the deceased and obtained favorable settlement

• Represented client in suits for breach of fiduciary duty against executor of father's estate and holder of mother's power of attorney and obtained favorable settlement

• Represented beneficiaries deprived of any benefit from family trust against trustee siblings who repeatedly engaged in self-dealing and breached fiduciary duties

Business and Commercial

• Represented manufacturer of high tech machinery sold internationally in breach of warranty and breach of contract litigation leading to abandonment of claims by plaintiff

• Used restraining orders and injunctions to obtain control of multi-location imaging center business when representing limited partners in litigation to remove general partner who misappropriated millions of dollars in partnership funds

• Represented primary financial investor in closely held corporation created to develop patented technology against officer who conveyed ownership of patents to his own corporation and achieved significant multi-party settlement

Real Estate and Municipal

• Represented City of University Park, Texas Board of Adjustment in a court challenge to the Board's reversal of a decision by the City's Director of Development to issue a building permit for large parking garage leading to sale of property by developer following City's win

• Represented heirs in partition actions involving large tracts of agricultural and commercial property held in joint tenancy
